Terms & Conditions

These Terms & Conditions ("Terms") govern your use of exotaria.com (the "Site") and any reservation, order, or purchase made through it. The Site is operated by Arrexar (Udyam Registration No. UDYAM-BR-26-0234389), trading as "Exotaria", with its registered office at 503, Patliputra Rail Parisar, Digha, Block A, Patna, Bihar – 800011, India ("we", "us", "our"). By using the Site, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to make a reservation or purchase on the Site. By placing a reservation or order, you confirm that you meet this requirement and that you are legally permitted to own and keep the species you are purchasing in your state of residence under the Wildlife Protection Act, 1972 and applicable rules.

2. Animals — reservation model

Animals listed on the Site are not sold via online checkout. Listings represent availability and indicative pricing only. To acquire an animal:

  • You submit a reservation request and verify your phone number via OTP. No payment is collected at this step.
  • We confirm availability, your eligibility, and any documentation requirements.
  • Once confirmed, a token/deposit amount (as communicated to you) is payable directly to us via UPI, bank transfer, or cash — not through an online payment gateway. We will provide our UPI ID / bank details directly.
  • The balance amount is payable before or at the time of dispatch, as agreed.
  • The reservation moves through the stages: reserved → confirmed → deposit paid → paperwork → shipped → delivered, visible on your reservation status page.

We reserve the right to decline or cancel any reservation at our discretion — for example, if the animal becomes unavailable, if we are unable to verify your eligibility, or if we believe the animal would not be kept in suitable conditions.

3. Store (accessories, feed, care kits, consultations)

Items such as accessories, feed, care kits, and paid care consultations may be purchased directly through the Site, where enabled. Payments for these items are processed by a third-party payment service provider (Paytm Payment Gateway). By making a payment, you also agree to the payment provider's terms. We never process or store live animals through this checkout flow.

4. Pricing

Prices are listed in Indian Rupees (INR) and are indicative for animals (final price confirmed at the time of reservation confirmation) and final/inclusive of applicable taxes for store items unless stated otherwise. We are not currently GST-registered; no GST is charged on invoices. Prices may change without notice, but the price agreed at the time your reservation/order is confirmed will be honoured.

5. Shipping

Live animals are shipped pan-India by train with a personal escort. Accessories and store items are shipped via courier. See our Shipping Policy for details.

6. Cancellations & refunds

7. Buyer responsibilities

  • You are responsible for verifying that the species you are purchasing is legal to keep in your state of residence.
  • You are responsible for having a suitable enclosure/setup ready before the animal is dispatched.
  • You must provide accurate contact and delivery information. We are not responsible for delivery failures caused by incorrect information.
  • You are responsible for declaring the animal under the PARIVESH portal where applicable; we provide documentation and guidance to assist with this.

8. Intellectual property

All content on the Site — text, images, logos, and care guides — is owned by us or our licensors. You may not reproduce or redistribute it without our written permission.

9. Limitation of liability

To the maximum extent permitted by law, our liability in connection with any order or reservation is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential losses. This does not limit our live-delivery guarantee as described in our Shipping Policy.

10. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory consumer-forum rights you may have, courts at Patna, Bihar shall have exclusive jurisdiction over any disputes arising from these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
